Welcome to TripInviter. These Terms of Use ("Terms") govern the use of our website and mobile applications (collectively, the "Service"). By using these you agree to be bound by these Terms.

1. The Nature of Our Service

The Service operates strictly as a private digital organizational folder and concierge. We do not sell, manage, or operate travel products, accommodation, transportation, navigation services, or activities. All trip itineraries, schedules, and logistics are entirely user-generated by independent Trip Organizers.

2. Security of Invitation Links and Access Codes

Organizer Responsibility: Trip Organizers are solely responsible for managing their guest lists and ensuring that unique trip invitation links are sent only to trusted individuals.

Unintended Access Disclaimer: TripInviter is not responsible or legally liable for any unauthorized access to private trip folders, itineraries, gate codes, booking references, or guest lists resulting from an Organizer or Guest accidentally sharing, forwarding, exposing, or losing control of an invitation link or account.

3. Accuracy of User-Generated Information & External Navigation

Data Validity: We do not verify or cross-check any information uploaded to a trip folder. TripInviter makes no warranties regarding the accuracy, safety, or validity of organizer-provided data, including whether a gate code is correct, whether a booking reference is valid, or whether a scheduled activity or trip destination is safe or legal.

External Mapping Disclaimers: When launching a destination into an external application (like Waze or Google Maps), TripInviter is not responsible for the routing accuracy or safety, road conditions, traffic delays, or navigation errors provided by those third-party services.

4. Prohibited Conduct

Users agree not to use the Service to:

Reverse engineer, scrape, or extract data from the app or website.

Upload malicious code, spam invitation links, or use the app to harass or stalk individuals.

Use the application while actively operating a motor vehicle. All navigation links (Waze, Google Maps) must be launched while parked or by a passenger.

5. Absolute Limitation of Liability

To the maximum extent permitted by law, TripInviter, its directors, and its employees shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your road trip or use of the Service. This includes, without limitation, liability for:

Property access failures, lockouts, or security issues resulting from incorrect gate codes or booking references.

Cancelled, delayed, or mismanaged activities (e.g., fishing trips, hotel reservation errors).

Traffic accidents, driving violations, property damage, or personal injuries sustained by any Organizer or Guest during a road trip organized via the app.

You indemnify and hold harmless us and our affiliates, officers, directors, employees and agents from and against any and all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your use of the Service.

6. Account Deletion and Shared Data

You may terminate your account at any time. Because trips involve a collaborative group history, deleting an Organizer account removes the Organizer's personal profile data, but the collective trip itinerary remains accessible to the invited Guests for their personal historical records.

7. Intellectual Property Rights

All intellectual property rights in and to the App, including its design, look and feel, source code, object code, graphics, user interface, text, logos, icons, databases, and any trademarks, trade dress and goodwill associated with the App (collectively, the "App IP") are owned by or licensed to us. You may use the App only as expressly authorised under these Terms. Except for the limited licence granted to you to use the App, you acquire no rights, title or interest in the App IP. All rights not expressly granted are reserved.

8. Governing Law

These Terms are governed by the laws of South Africa, and any disputes will be resolved exclusively in the courts of George, Western Cape.
